1. Acceptance of Terms

Welcome to FlyFren. By accessing or using the FlyFren website, mobile application, or related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

2. Eligibility

You must be at least 13 years old to create a FlyFren account. By using the Services, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@flyfren.com if you suspect unauthorized access.

4. Aviation Use Disclaimer

FlyFren provides flight planning information, weather data, navigation references, and logbook tools as informational aids only. The Services are not a substitute for official aeronautical sources, an FAA-approved flight plan, or pilot judgment. As pilot in command, you are solely responsible for the safe operation of your aircraft and for compliance with all applicable aviation regulations including 14 CFR Part 61 and Part 91. Always cross-check data from FlyFren against official sources before any flight.

5. Your Content

You retain ownership of the flight logs, photos, comments, and other content you submit to FlyFren ("Your Content"). You grant FlyFren a worldwide, non-exclusive license to host, display, and process Your Content solely as needed to operate and improve the Services. You can export or delete Your Content at any time from your account settings.

6. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of any aviation regulation;
Upload content that infringes another person's rights or that you are not authorized to share;
Attempt to reverse-engineer, scrape, or interfere with the Services;
Misrepresent your identity, credentials, or pilot certificates.

7. Subscriptions and Billing

Paid plans are billed in advance on a recurring basis (monthly or annual) until cancelled. You can cancel anytime; cancellation takes effect at the end of the current billing period. Annual plans cancelled mid-cycle are eligible for a prorated refund of the unused portion. Prices and features may change with reasonable notice.

8. Termination

You may close your account at any time. We may suspend or terminate access to the Services if you violate these Terms or engage in conduct that we reasonably believe creates risk for FlyFren or other users.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FlyFren does not warrant that weather, NOTAM, airport, or routing data is accurate, complete, or current.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYFREN AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID FLYFREN IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in San Francisco County, California.

12. Changes

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms here with a new "Last updated" date and, where appropriate, by email. Continued use of the Services after the update means you accept the revised Terms.
